The judges' council deemed the actions related to the searches of Judge Ivchenko as indicative of interference in the administration of justice.

The RSU has deemed the actions related to the searches conducted at the premises of the Economic Court of Kyiv and at the residence of Judge Anatoliy Ivchenko, without a ruling from an investigative judge, as indicative of interference.

On January 22, 2025, a meeting of the Council of Judges of Ukraine took place, during which one agenda item was discussed: the appeal from the assembly of judges of the Economic Court of Kyiv concerning interference in the activities of a judge and the need to ensure the independence of judges and the authority of justice. This was reported by the Council of Judges of Ukraine. Twenty-three members of the Council of Judges participated in the meeting.

As reported by the “Judicial and Legal Newspaper”, the assembly of judges of the Economic Court of Kyiv was convened in response to events that occurred in the courthouse involving Judge Anatoliy Ivchenko. The judge himself had previously addressed the Council of Judges of Ukraine.

Overall, investigators from the State Bureau of Investigations (SBI) conducted searches in the judge's office and residence, and also issued him a notice of suspicion for committing treason. These actions by the SBI were related to a decision he made in September 2012 regarding case No. 5011-61/11340-2012. This decision was upheld by the ruling of the Kyiv Appeal Economic Court on December 3, 2012, and by the resolution of the High Economic Court of Ukraine on January 21, 2013; however, a ruling by the High Economic Court of Ukraine on May 20, 2013, denied the case's admission to the Supreme Court of Ukraine. As previously noted in a comment by Anatoliy Ivchenko, “it is clear that the investigation did not even attempt to determine who exactly in the court of cassation left the decision unchanged; the quality of the suspicion is evidenced by this text: ‘someone interfered in the activities of the judges of the Supreme Court of Ukraine, who left unchanged the decision of the Economic Court in Kyiv dated September 19, 2012, and the ruling of the Kyiv Appeal Economic Court dated December 3, 2012.’ Please note – this case has never been under the jurisdiction of the Supreme Court of Ukraine.”

“We have just discussed the draft resolution and agreed that there is a need to adopt such a resolution and, in accordance with the operative part, to recognize the actions related to the searches in the premises of the Economic Court of Kyiv and at the residence of Judge Anatoliy Mykolayovych Ivchenko as lacking a ruling from an investigative judge, containing signs of interference in the judge's activities in administering justice and threatening judicial independence,” said the Chairman of the Council of Judges of Ukraine Bogdan Monich.
