In Ukraine, the term "collectors" is often linked with threats, blackmail, and psychological pressure; however, the activities of collection companies are regulated by law.

This was reported by the National Bank of Ukraine.

How not to interact with a debtor

Creditors can only work with legal collection companies that are registered with the NBU. According to the law "On Consumer Lending," collectors are prohibited from:

Gathering personal information about the debtor, particularly regarding their health, workplace, travel, etc.

Using threats, blackmail, or psychological/physical pressure.

Providing false information regarding the debt repayment deadlines and demanding compensation for their services.

Contacting during nighttime (from 8:00 PM to 9:00 AM) and on public holidays or weekends.

Utilizing auto-dialing for more than 30 minutes a day.

Informing third parties about the debt or harming the debtor's reputation.

Meeting with the debtor without prior agreement.

Contacting the debtor more than twice a day without their initiative.

Collectors are allowed to negotiate only during business hours (from 9:00 AM to 8:00 PM) and only with the debtor’s prior consent. They also have the right to send written messages.

What to do in case of a violation?

If you encounter threats or blackmail, contact the financial institution that ordered the collection services. If this does not resolve the issue, gather evidence of the threats and submit it to the National Bank through the online service Opendatabot. In cases of violence, contact the police.

It is important to note that the National Bank will not assist if the company is not registered as a legal collector. In such cases, you should reach out to law enforcement agencies.
