SubscribeLawyer Ilya Kolesnik from Prikhodko&Partners explained how to act if the bank has withdrawn your entire salary.
Why did the bank take all the money?
Here are a few reasons why your salary might have "disappeared":
- Loan debt. The bank may automatically withdraw funds to cover debt if this is specified in your contract.
- Court decision. If there is an enforcement proceeding, money can be withdrawn in favor of creditors without your consent.
- Overdraft. Did you spend more than what’s available on your card? The bank compensates the difference by withdrawing funds as soon as they arrive.
- Account freeze. This is done by court order, tax authorities, or creditors. Your entire balance may be blocked.
- Bank error. Yes, sometimes withdrawals occur due to a simple mistake or unlawful actions.

- Contact the bank. Write a statement requesting an explanation of the situation. Remind the bank that you have the right to a minimum balance for subsistence needs.
- Check the debtor registry. This can be done on the Unified Registry website. If there is an enforcement proceeding, find out who initiated it.
- Go to court. If the actions of the enforcement service or the bank are unlawful, file a complaint or demand the establishment of a minimum balance in your account.
Your rights
According to the law (Article 73 of the Law "On Enforcement Proceedings"), you have the right to a minimum balance equal to the subsistence minimum. If the bank or service has withdrawn everything, demand the restoration of this balance through the court or enforcement service.
