The inheritance in Ukraine includes not only assets but also debts and other obligations of the deceased. However, some personal rights and responsibilities cannot be inherited, experts from the Kharkiv Human Rights Group explained, writes the Legal Aid portal.

According to the Civil Code of Ukraine, the following are not included in the inheritance:

  • personal non-property rights;
  • rights to alimony, pensions, social assistance;
  • the right to compensation for injuries or health damage;
  • the right to membership in organizations (with specific exceptions).

As for debts, heirs are obligated to settle them only up to the value of the inherited property. Such debts include obligations under civil contracts, expenses for medical treatment and burial (limited to three in recent years), as well as court fines and compensations.

Heirs may also receive unpaid income of the deceased, such as salary, pension, or compensation for injuries. If there are no heirs, these funds become part of the general inheritance.

Thus, the legislation clearly delineates which rights and obligations can be transferred to heirs and which remain personal to the deceased.
