It turns out that illegal services can operate without hindrance, and the National Bank of Ukraine is not only unable to stop this but also seems unwilling to do so, journalist Sergey Lyamets stated in his blog on the Censor website. He noted that recently the NBU published an official decision regarding the illegality of financial services provided by BitCapital. The regulator's website comments that:
- The NBU received over 700 complaints from affected individuals;
- People complained about excessively high rates, unjustified charges on loans, and aggressive debt collection;
- Debts, lack of transparency in terms;
- BitCapital effectively lent in hryvnias;
- Loans were provided outside the legal framework of Ukraine;
- BitCapital did not have a legal entity in Ukraine, although it claimed to operate through English;
- companies GOLDEN INTEREST GROUP LIMITED and/or SOCIAL FINANCE CARE AND WELLBEING INVESTMENTS LLP;
- Lending occurred via a website and mobile application;
- The website contained no information;
The situation is further aggravated by the fact that the NBU ignored numerous appeals since last year, when complaints from clients began to come in. Only on January 13, 2025, did Olga Lobaychuk, head of the financial services consumer protection department, provide a response that effectively boiled down to: "go to the police, it's not our business." This attitude from the regulator towards the situation is simply shocking, noted Lyamets.
This means that the regulator not only delayed its response but effectively distanced itself from solving the problem. Instead of promptly addressing the numerous complaints, the NBU simply denied consumers protection. This can be seen in the screenshot below, the journalist writes.
Despite formal warnings, representatives of BitCapital continue their activities: they persist in charging unclear interest rates and threatening debtors and their families. The BitCapital website is still operational, and fraudsters continue to operate freely in Ukraine's financial market, noted Lyamets. And despite numerous complaints, the situation remains unchanged, the expert writes.
