The state-owned "Oschadbank" granted a client a loan of 30,000 hryvnias, but just a few minutes after the agreement, the entire amount was deducted from his card.

The "Oschadbank" client intended to use the loan funds to purchase a power tiller. However, immediately after the loan was approved, the entire amount was withdrawn from his account. Realizing that he had lost his money, the man went to the "Oschadbank" branch where he had taken out the loan, but they were unable to assist him.

The "Oschadbank" client filed a report with the police. During the pre-trial investigation, it was discovered that the funds from his card were transferred to an account at "TAScombank," then to an account at "Universal Bank," and later to a user of "Ayboks Bank." Thus, the money was embezzled by fraudsters.

Despite these circumstances, Oschadbank insisted that the client had voluntarily provided the fraudsters with confidential information and continued to demand repayment of the loan along with interest.

The client took the matter to court, seeking the return of 27,500 hryvnias — the amount fraudulently deducted from his loan funds. The Desnyansky District Court of Chernihiv ruled in favor of the plaintiff.

The deduction from the plaintiff's account occurred without his instruction. The plaintiff immediately notified the bank about the unjustified deduction and contacted law enforcement. The bank could not provide evidence that the client had either actively or passively facilitated access to his account or had shared information with third parties that enabled the initiation of payment transactions. Therefore, the court deemed the plaintiff's claims valid and granted his lawsuit.
